Whether you book directly with us or through a retail/wholesale travel agent, your contract will be considered with India Tours and Travels.

By booking with us, it is understood that you have accepted our booking conditions. These conditions outline important information regarding payment, cancellation, refund policies, liability, complaints, and other relevant details. It is important to carefully review these conditions to ensure you understand your rights and obligations when booking a holiday with us.

DEFINITION

References to “we”, “us”, and “our” in these terms and conditions (Terms and Conditions) refer to India Tours and Travels and to “you”, “your”, “customer(s)” and “traveller(s)” refers to the named person who places the order and where the context requires (including in respect of liability and responsibility provisions) includes all persons intending to travel on the order.

We are a proprietorship company registered in Gurgaon (NCR - DELHI) with the Department of Tourism (DOT) 1803180H262 and Indian Association of Tour Operators (IATO) ADL111210 and our registered address is H -221, Upper Ground Floor, Sushant Shopping Arcade, Sushant Lok - 1, Gurugram, Haryana – 122002, Haryana – NCR Delhi. ACCEPTANCE OF OUR CONDITIONS

The below-mentioned terms and conditions (Terms and Conditions) are applicable on all the bookings made with India Tours and Travels by any individual traveller and group of travellers planning to avail of the services of India Tours and Travels directly or through our associates/retail agents located in overseas countries.

During the booking process, customer(s)/traveller(s) will be required to acknowledge and confirm that you have read and accepted the below Terms and Conditions.

By acknowledging the Terms and Conditions customer(s)/traveller(s) confirms that:

• You are 18 years of age or over and have the legal capacity and authority to make the booking and accept these terms and conditions (Terms and Conditions) on behalf of everyone in your group/party.

• You have read, understand, and agree to comply with the terms and conditions (Terms and Conditions)

• It is your responsibility to be aware of and comply with all health, medical, insurance, passport, and visa requirements of the country or countries you plan to visit. This includes obtaining all necessary documents, health insurance, travel insurance, and vaccinations before your travel.

India Tours and Travels will only communicate and transact with the person named as the lead booking contact on any tour stated on our website. We will not disclose any personal information in our records, except when required for authorized purposes or with the consent of the account holder concerned.

PRICING, DEPOSITS, AND PAYMENTS

3.1 PRICING

All prices displayed on our website are quoted on a per-person basis considering twin/double share rooms and are inclusive of all applicable taxes. We are committed to honouring the contracted prices for all our tours. However, in the event of any cost increase due to factors such as new government taxes, changes in existing government taxes, revisions of airfare or airline taxes, or fuel price hikes, any additional costs resulting from customer(s)/traveller(s)-initiated booking modifications or modifications made by India Tours and Travels due to non-availability of specified hotels or services, or other unforeseen circumstances beyond our control will be solely borne by the customer(s)/traveller(s). India Tours and Travels will not assume responsibility for such additional charges.

3.2 SINGLE ROOM

All our tour pricing is based on double/twin-sharing occupancy, with two individuals sharing a twin or double room throughout the tour. However, we also provide the option for the customer(s)/traveller(s) to select a single room for their exclusive use, thus avoiding the need to share accommodations with another customer(s)/traveller(s). We strive to offer a range of options that meet the needs and preferences of all our valued customer(s)/traveller(s). Single room prices will be different from twin/double and triple share prices.

3.3 TWIN/DOUBLE SHARE ROOMS

All our tour pricing is based on double/twin-sharing occupancy, with two individuals sharing a twin or double room throughout the tour.

3.4 TRIPLE SHARE ROOMS

If choosing a triple share, then the bedding configuration available for a triple share is likely to include the usual bedding configuration options (Twin/Double) plus another single bed or ‘rollaway’ bed will be provided to accommodate the third person in the same room. Triple share room prices will be different from twin/double share prices. *Triple share rooms are only permissible in “Private Journeys” and “Tours around 1200”. It is not permissible in any of our Group Journeys and Luxury Trains and Cruises.

Whenever customer(s)/ traveller(s) sharing a twin/double or triple room and feel that they are not happy to continue sharing their room with a travel partner during the tour or before the tour and feel like choosing the single room then, it is a customer(s)/traveller(s) responsibility to pay the mandatory single room price. India Tours and Travels accepts no responsibility in the event you are incompatible with your travel partners(s) for any reason. All prices listed for our tours are denominated in Euro (€), United States Dollars (US$), and Great British Pound (£). These prices are subject to availability and may be withdrawn or modified without any prior notice.

India Tours and Travels retains the right to refuse the acceptance of published prices that have been deemed erroneous as a result of printing, clerical, or electronic mistakes. This policy is enforced to ensure that our customers receive accurate pricing information and to preserve our organizational integrity. We will take all the necessary measures to rectify the error and provide you with updated pricing information if such an occurrence arises. We appreciate your understanding and cooperation in this matter. In case of a price decrease, we are not obligated to refund you to match any subsequent price reduction after your order has been placed.

There may be additional charges, supplements, or surcharges that you need to pay after you place your order. The final price may also be affected by factors such as any customizations or additions you make, changes to travel arrangements by India Tours and Travels in the case of non-availability of any travel services including accommodation, fluctuations in currency exchange rates, fuel surcharges, government taxes, levies and airfare increases. We reserve the right to adjust fees, charges, or prices.

3.5 DEPOSITS

The balance amount for your upcoming tour must be settled no later than 45 days before the scheduled departure date. It is important to note that the final documentation will only be released upon receipt of the full payment by the deadline. In the event of a payment delay without prior notification or due cause, we reserve the right to consider your booking cancelled and retain the deposit. We kindly request that you comply with the payment terms and conditions outlined to ensure a seamless and enjoyable holiday experience.

3.6 Payments

For all our tours, payment can be made by a direct bank transfer, Visa and MasterCard debit cards, Visa and MasterCard credit cards and American Express cards. Please note that when paying by bank transfer, your booking will only be secured once the funds have cleared into our account. All payments should be free and clear of any withholding tax and deduction. Bank charges, if any, for remittance (by remitting bank or by intermediary bank) would be strictly borne by the payer.

India Tours and Travels reserves the right to modify all its fees from time to time in the case of revision or increase in any fee, duty, taxes etc. Customer(s)/Traveller(s) may be required to sign documents authorising India Tours and Travels to charge their cards as per the regulations of banks or credit card services.

India Tours and Travels shall not be responsible for any sort of illegal transaction made by the customer(s)/Travellers(s). It will be the sole liability of the customer(s)/Travellers(s). Upon detection of such an illegal transaction, it would be India Tours and Travels' decision to retain the customer(s)/Travellers(s) or cancel the services.

MINIMUM AND MAXIMUM NUMBER CRITERIA

(i) Private Journeys, Tours around 1200, Luxury Trains and Cruises

All our journeys except the Group Journeys can be booked by a minimum of one (single) paying traveller(s)/customer(s) limited to 10 paying traveller(s)/customer(s) to provide the best services and experiences. However, we will be more than happy to serve you in case you want to book a tour with us which has more than 10 participants and it will be treated as an ad-hoc small group.

(ii) Upcoming Group Journeys

All tours listed under the Upcoming Group Journeys section require a minimum of four (04) participants/travellers/customers to guarantee departure unless otherwise specified.

(iii) Prices for all Upcoming Group Journeys are based on a minimum of four participants unless otherwise specified. To ensure the best experience, group sizes are limited to 16 participants. We can also accommodate larger groups, which will be treated as ad-hoc.

INCLUSIONS AND EXCLUSIONS

The Inclusions and exclusions of a tour shall vary from one to another. Please refer to the Inclusion and Exclusions section carefully before booking any tour. Under no circumstances, does India Tours and Travels include the cost of any kind of international Airfare, insurance such as insurance for travel, travel protection, health, medical repatriation etc. It will be the customer(s)/Traveller(s) responsibility to purchase all the necessary travel insurance before departing their country.

Accommodation

All hotels listed in our Private Journeys, Upcoming Group Journeys, Top Tours Around 1200, Luxury Trains, and cruises are meticulously selected and personally inspected by India Tours and Travels team. Accommodations are based on the standard room category unless otherwise specified. All rooms are subject to availability at the time of booking. In the event of non-availability, India Tours and Travels will provide a suitable alternative of the same standard. During peak periods, an additional supplement charge may be necessary for higher-category accommodations if the preferred options are unavailable.

Standard hotel check-in is 1400 hrs. and check out at 1200 hrs.

India Tours and Travels cannot guarantee you twin share/adjoining/interconnected rooms. The same would be subject to availability at the time of booking.

All rooms are booked as non-smoking, but some accommodations may not have dedicated non-smoking rooms.

Please note the below room capacity which customer(s) / traveller(s) must adhere:

Single Room – Only 01 Adult is permissible.

Twin Room – Only 02 Adults are permissible.

Double Room – Only 02 Adults are permissible.

Triple Room – (Double/twin bed + Rollway bed) - Only 03 Adults are permissible + 01 child (up to 05 years of age sharing the bed with parents)

TRANSPORTATION, TRANSFERS AND VEHICLE SEATING CAPACITY.

All the tours that we provide include air-conditioned vehicles by default unless otherwise specified. Our air-conditioned vehicles are designed to ensure comfortable and safe transportation for all passengers, regardless of external weather conditions. Our commitment to providing a satisfactory and enjoyable experience for our customers is reflected in our provision of air-conditioned vehicles.

The roads in India, Bhutan, Nepal, and Sri Lanka are known for their unpredictability and frequent narrowness, bumpiness, and potholes. It is not uncommon to encounter wandering livestock along these roads, which may cause unexpected delays and variations in journey times that are beyond the control of India Tours and Travel. Nevertheless, it is worth noting that all our chauffeurs are highly trained and experienced professionals, able to navigate these unpredictable scenarios with utmost safety and skill.

If any tour under Upcoming Group Journeys does not have enough participants to fill a full-sized coach, India Tours and Travels reserves the right to use a smaller form of transportation.

All our tours include only a single transfer service for the entire group upon arrival and departure. If any customer(s)/traveller(s) arrives ahead of schedule or departs later than the scheduled transfer, and requires a separate transfer service, an additional cost will be incurred. The customer(s)/traveller(s), in this case, will be required to bear the cost of this supplementary service before availing it.

7.1 VEHICLE SEATING CAPACITY

• 01 Pax (travelling solo): Hyundai Aura or Maruti dzire or Toyota Etios or similar.

• 01 to 03 Pax: Toyota Innova or Kia Karens or Suzuki Invicto or similar.

• 04 to 08 Pax: Force Tempo Traveller or Force Urbania or similar.

• 09 to 14 Pax: Mini Coach (18-seater) or similar.

• 15 to 30 Pax: Large Coach (35 to 38-seater) or similar.

• 31 to 38 Pax: Volvo Coach (41-seater) or similar.

TOUR GUIDES AND TOUR LEADERS

(i) Upcoming Group Journeys

All our tours under Upcoming Group Journeys are led by experienced English-speaking Tour Leaders as specified in the “What’s Included section”.

India Tous and Travels reserves the right to change the tour leader owing to the tour leader's health, personal and family emergencies. In such rare cases, we take full responsibility for providing a similar replacement.

(ii) Private Journeys and Tours around 1200

All our tours under Private Journeys and Tours around 1200 are inclusive of experienced English-speaking local city guides as specified in the “What’s Included section”.

SHOPPING AND MAKING PURCHASES

India Tours and Travels does not assume any responsibility for the quality or value of goods purchased or the suitability of any retail outlets visited during travel. The decision to purchase goods and the use of a credit card for those transactions is entirely at your own risk and discretion. You, as the customer(s)/traveller(s), must always exercise caution and judgment. India Tours and Travels will not be held liable for any expenses, fees, penalties, costs, liabilities, damages, or losses incurred because of transactions you make while travelling. Moreover, it is your responsibility to research and declare all relevant items to comply with local customs laws, and any items that are confiscated will not be compensated.

FLIGHTS

India Tours and Travels retains the right to modify, extend, change or cancel any flights published in our tours. It is important to note that such changes are beyond our control, as airlines reserve the right to reschedule or cancel flights at their discretion. As a result, flights may involve late departures, early arrivals, transit, or a substitute airline. We understand that these changes may cause inconvenience to our clients, and therefore, we strive to minimize the impact by providing timely and accurate information regarding such changes.

Airfare for all domestic flights is included in the tour cost unless and until specified. All the airfares included in the tour cost are dynamic and subject to change without any prior information until booked/ticketed which may affect the price of the tour after booking.

Airfare for any International flight is not included in our tour prices unless and until specified. However, if you would like us to arrange your international flights or make suggestions on the best routes and timings then we are happy to do so.

Customer(s)/Traveller(s) is responsible for all the extra costs occurring from extra luggage, any seat preference, any kind of upgradation (for example Economy class to Premium Economy class or Business Class, etc), any sort of penalties, any purchase within the airport (domestic or international), in-flight meals, donations, etc.

India Tours and Travels shall not be held liable for any failure by the customer(s)/traveller(s) to arrive at the airport at the scheduled time and subsequently miss their flight. It is the responsibility of the customer(s)/traveller(s) to ensure that they arrive at the airport promptly and allow sufficient time for check-in, security screening, and other necessary procedures. Any delay or failure to arrive on time may result in missed flights and additional costs, which shall be borne solely by the customer(s)/traveller(s). Therefore, we encourage all our customer(s) and traveller(s) to plan their journeys carefully and allow adequate time for unforeseeable circumstances.

• In terms of Domestic flights: Please reach the airport at least 02 to 02 1/2 hours before your flight departure.

• In terms of international flights: Please reach the airport at least 03 to 03 1/2 hours before your flight departure.

India Tours and Travels will not be held responsible if travellers/customers do not carry valid passports, visas, or any other travel documents while travelling on domestic/international flights.

In the event of an airline cancelling a flight or ticket, India Tours and Travels must regretfully inform our valued customers that we are unable to reverse the decision. Consequently, any costs or losses incurred by the customer(s)/traveller(s), including the expenses incurred for re-booking flight tickets, as well as transfers/accommodation required to catch up with the tour, are the sole responsibility of the customer(s)/traveller(s). Please note that under these circumstances, no refunds, free-of-charge replacement tour departure dates, or other itinerary changes are permissible.

In the event of connecting flights, if the first flight is missed or the customer(s)/traveller(s) fail to board, check-in or notify of a cancellation, then the remaining flight for the next destination would be cancelled automatically by the airline.

Flight details (numbers/timings) mentioned in our tours are subject to change without prior notice, as they depend entirely on the airline and airport authorities. Such changes are beyond our control.

Please be aware that if the flight is rescheduled by the airline and the new arrival time is early morning or the departure time is late at night, the customer(s)/traveller(s) will be responsible for any additional costs incurred due to early check-in, late check-out, or an extra night stay (subject to availability). It is important to note that the standard check-in time at the hotel/resort is 1400 hrs. and the standard check-out time is 12:00 hrs. Please note that India Tours and Travels is not liable to bear any additional costs incurred due to these circumstances.

Trains

India Tours and Travels has the authority to make changes to any published train schedules mentioned in our tours. This means that trains may depart later or arrive earlier than scheduled, or a different train may be used as "Indian Railways" has the right to reschedule or cancel trains at any time. Please note that such changes are not in our control.

The availability of train tickets at the time of booking is subject to circumstances. If India Tours and Travels is unable to secure a ticket on the intended train, we reserve the right to arrange the best available alternative option. This may necessitate booking a train with different arrival and departure timings, a different class as per actual availability, or a change in mode of transportation, such as a flight or vehicle, whichever is feasible. It is important to note that any additional expenses incurred will be the sole responsibility of the customer(s)/traveller(s), and India Tours and Travels will not be liable for such expenses.

It is important to note that India Tours and Travels assumes no responsibility for any cancellations, rescheduling, changes in arrival/departure times or delays, or changes in tier (such as from 1st AC Tier to 2nd AC Tier or 3rd AC Tier, or vice versa) made by Indian Railways. Moreover, we do not accept any liability for any loss of valuable items or documents during train travel. We recommend that passengers take necessary precautions to safeguard their belongings during their journey.

When you book a ticket with India Tours and Travels, you will receive a physical train ticket along with other necessary documents upon arrival. Please ensure you keep this ticket safe, as we cannot be held liable for any loss or misplacement. We recommend that all customers/travellers store their tickets in a secure and easily accessible location.

India Tours and Travels shall not be held responsible if any customer(s)/traveller(s) misses their train due to traffic jams during their transfer to the railway station. We also cannot be held responsible if the customer(s)/traveller(s) does not follow the departure timing given by our executive or misplace their train ticket, passport, or any other travel document.

Portage at the railway station is not included in any of our tour’s prices. Customer(s)/traveller(s) shall be responsible to pay the portage directly (if the service of a porter is used). India Tours and Travels shall not bear the cost of portage.

LUXURY TRAINS AND CRUISES

If a customer(s)/traveller(s) is unable to board a scheduled departure for a luxury train or cruise, they must immediately notify either us or the luxury train or cruise company. Failure to do so may result in the forfeiture of the entire booking or additional expenses being incurred at the expense of the customer(s)/traveller(s).

Please note that in case of a missed luxury train or cruise departure, the associated costs of re-booking the cabin or luxury train/cruise, as well as transfers, accommodation, and other necessary arrangements to catch up with the scheduled journey, will be borne by the customer(s)/traveller(s). Kindly note that no refunds, free-of-charge replacement tour departure date changes, or any other itinerary modifications will be permitted in such circumstances.

It is highly recommended that all customer(s)/traveller(s) take necessary precautions and make arrangements to arrive at the railway station/port well in advance to minimize the risk of potential delays or cancellations, as well as the possibility of missing the departure of the luxury train/cruise. When booking an international flight, it is solely the responsibility of the customer(s)/traveller(s) to select a flight schedule that takes into consideration any potential flight delays, ensuring that it does not impede their ability to reach the railway station/port on time.

If flights are incorporated with the luxury train/cruise component by India Tours and Travels, extensive planning has been undertaken to mitigate any potential disruptions from minimal flight delays that may affect the customer(s)/traveller(s) ability to meet the railway station/port departure. However, should such delays impact the scheduled departure, we reserve the full right to modify, adjust or re-issue the flight with different times to ensure that customer(s)/traveller(s) arrives at the railway station/port before the luxury train/cruise's scheduled departure.

Cabin category selection, cabin upgrades, and any other luxury train/cruise-related requests are strictly subject to availability and are not guaranteed. Cabin placements are allotted as per the availability basis, and some cabins will have obstructed views in both luxury trains and cruises.

Luxury trains/cruise authorities reserve the right to make changes to the program, if necessary, at any point in time. This change can be due to an insufficient no. of passengers on a particular departure or due to certain operational reasons & conditions. In this case, Luxury trains/cruise authorities reserve the right to cancel the departure or amend the same.

ARRIVE EARLY/STAY BEHIND

It's important to note that all our tours under "Upcoming Group Journeys" come with the option to arrive early or stay behind, which can be found This is a valuable option for the customer(s)/traveller(s) with international flights arriving or departing at odd hours. If you want to ensure that you have a room available upon arrival or until departure, along with an additional transfer, then selecting the arrive early/stay behind option is the way to go. However, please keep in mind that these requests are subject to availability and the hotel's discretion.

TRAVEL DOCUMENTS, PASSPORTS AND VISA

14.1 TRAVEL DOCUMENTS

You will receive an email containing all the travel documents approximately 02 weeks before your departure over the registered email which includes your final itinerary, hotel details (confirmations, addresses, contact numbers), hotel and service vouchers, flight and train tickets (if purchased through us), and list of our local offices for each destination (as per your itinerary), pre-departure information which includes general information about the country such as electricity, traditions, tipping, etc. and a feedback form.

*It is important to note that all the mentioned travel documents are solely intended for personal record-keeping purposes, except flight-related documents. Upon your arrival, these documents will be presented to you alongside a welcome kit. We kindly request that you refrain from printing these documents, as they are intended for personal reference only*.

14.2 PASSPORT AND VISA

It is solely your responsibility to ensure that you have met all the necessary passport, visa, and immigration requirements. Therefore, we strongly advise that you verify these requirements with the respective Embassies and/or Consulates in your country. We will not be liable for any inconvenience caused due to your inability to travel because you have not complied with any passport, visa, or immigration requirements.

(i) PASSPORT

Your passport should have a minimum validity of six months from the intended date of return to your country and should contain at least two to three blank pages for the issuance of a visa (additional pages required if visiting more than one country).

Please be advised that it is mandatory to send a valid scanned copy of your passport via email to mail@indiatoursandtravels.com within 72 hours of making an online booking on our website. This is a non-negotiable requirement, as certain trips may involve visits to national parks, domestic flights, and train bookings that necessitate special permits. To obtain these permits, a scanned copy of your passport is an absolute must.

14.3 VISA

It is mandatory that all customer(s)/traveller(s) thoroughly check and understand all visa requirements, including e-visas, visas on arrival, medical visas, transit visas, single entry, or multiple entry visas, etc., as well as the entry and exit regulations of their travel destinations. Please note that it is the sole responsibility of the customer(s)/traveller(s) to ensure compliance with these requirements. We strongly urge all customer(s)/traveller(s) to take this matter seriously to avoid any inconveniences or complications.

In countries where a visa is necessary, it will be required for you to provide confirmed details of your travel itinerary such as confirmed accommodation and flight tickets (if purchased through our platform). You will receive all this information in your travel documentation that will be emailed to you.

India Tours and Travels cannot be held responsible in case you are unable to travel due to the lack of appropriate visas or immigration documents, regardless of the reason. The responsibility for obtaining these documents and any associated expenses, fees, penalties, costs, liabilities, damages, or losses lies solely with you. In such a case, you will not be entitled to any kind of refund.

TRAVEL INSURANCE, HEALTH, AND SAFETY

15.1 TRAVEL INSURANCE

Having adequate and valid travel insurance for all travellers before their departure is compulsory. It is advisable that your travel insurance must cover personal accidents, evacuations, repatriation, medical expenses, baggage loss and cancellation or curtailment of a tour, International and domestic flights, and cruises. India Tours and Travels reserves the right to request the travellers to produce travel insurance documents upon their arrival in India, Nepal, Bhutan, Sri Lanka, and Maldives. In the event of travelling without obtaining adequate travel insurance, India Tours and Travels reserves the right to cancel the tour without any kind of refund.

If travellers wish to travel without adequate or no insurance cover then the tour shall be at their own risk and India Tours and Travels shall not be liable for travellers' losses/expenses/claims arising out of a personal accident, evacuations, repatriation, medical expenses, baggage loss during the tour and cancellation or curtailment of a tour, International and domestic flights, and cruises. Moreover, Travellers must sign a disclaimer, indemnifying India Tours and Travels of all liabilities; losses/expenses/claims arising out of such travel.

15.2 HEALTH AND SAFETY

Please be aware that your itinerary may include sections with high altitudes exceeding 10,000 feet (3,048 meters). If you have any medical conditions related to circulation, heart, or respiratory issues, you must consult with your doctor before confirming your tour booking. While there are no compulsory vaccinations for travel to India, Nepal, Bhutan, Sri Lanka, or Maldives, we strongly advise you to protect yourself against Polio, Malaria, Tetanus, Typhoid, Hepatitis, and COVID-19. It is highly recommended that you consult your doctor at least 2-3 weeks before your travel date for all sorts of medical advice.

All customer(s)/traveller(s) must have the necessary fitness, whether physical, medical, or otherwise, to ensure that they are fit for travel. Before making any orders, it is your responsibility to check and be aware of any specific health requirements for your travel destination(s). You must also ensure that any applicable needs can be met during your travels. Please take this matter seriously as it is crucial for your safety and wellbeing during your trip.

This section is crucial to ensure that you are fully aware of whether you are authorised to carry or use specific medications and medical/mobility equipment during travel, as well as the regulations concerning batteries for flights and cruises. It's essential to note that you must provide the necessary medical documentation, such as prescriptions or medical certificates if required.

For some countries, a failure to disclose a health condition, proof of vaccination or a medical certificate may result in the applicable country/airline/cruise refusing you entry/boarding, or in you being detained, expelled, or repatriated from the applicable country at your cost.

All medical requests, including mobility aids, access to power, refrigeration, etc are subject to various factors, such as transportation, destination standards, accommodation options, and the policies of airlines, cruises, and trains. It is important to note that these requests are entirely outside the control of India Tours and Travels. Although we will make every effort to meet your request, we cannot guarantee that we will be able to do so.

Before placing an order with India Tours and Travels, it is incumbent upon you to ensure that you are cognizant of the safety conditions and potential issues that may exist or arise at your travel destination(s). You are responsible for complying with all local laws, regulations, and customs in every country and location that you visit, which may differ significantly from those in your home country.

BOOKING A TOUR AND TOUR CONFIRMATION

17.1 BOOKING A TOUR

India Tours and Travels always strives to provide the highest level of customer service. While we make every effort to fulfil all bookings, we reserve the right to decline the booking for various reasons, such as inaccuracies in product descriptions or pricing errors. We also reserve the right to cancel the booking if a service becomes unavailable or if an error occurs during order processing.

By making a booking with us, you acknowledge that we retain the right to promptly remove any individual(s) from your travel group if their behaviour affects the safety or enjoyment of other tour members. We will not tolerate any unsocial, illegal, disruptive, or unruly behaviour, or the carriage of prohibited substances or materials. Additionally, if any customers are physically unable to undertake the tour arrangements, we reserve the right to exclude them from the tour.

Apart from permissible free time as listed on the itinerary, all customer(s)/traveller(s) must remain with the tour to ensure the smooth and efficient operation of the tour, as well as the safety and security of all participants. In the unlikely event that someone needs to leave the tour for any reason, prior approval must be obtained from India Tours and Travels.

In the unlikely event that a customer cannot be located despite reasonable efforts, local authorities must be contacted immediately. Subsequently, the remaining tour components will be cancelled without delay, and no refund or partial refund will be provided.

17.2 BOOKING CONFIRMATION

After following the payment (deposit/or full), the customer(s)/travellers(s) will receive an email from one of the reservation team members to ensure that the booking made by the customer(s)/travellers(s) is accurate and request to share the scanned copies of your passport. Once the customer(s)/travellers(s) are done sharing passport copies, our team will process the reservation and revert to the registered email address within 24 to 48 hours with the booking confirmation.

When booking hotels, domestic flights, and trains, please note that availability cannot be guaranteed. If any of these components are unavailable, our team will notify the customer(s)/travellers(s), via registered email address. We will provide the best possible alternative arrangement in a similar category for the same cost or in a higher category for an additional supplement depending on the availability. The email will also provide further information about the process.

You must read and adhere to the instructions listed on your booking confirmation. Failure to do so will result in India Tours and Travels not being liable for any expenses, fines, penalties, costs, liabilities, damages, or losses incurred. Please take this seriously and ensure that you carefully follow all instructions provided.

ALTERATIONS AND CANCELATION

18.1 ALTERATIONS

ALTERATIONS TO THE TOUR/TRAVEL ARRANGEMENTS BY
If the customer(s)/travellers(s) wish to alter their tour/travel arrangements after the booking has been confirmed, please communicate your request in writing to mail@indiatoursandtravels.com or you’re the file handler’s email, India Tours and Travels will make every effort to assist, although we cannot guarantee the requested changes can be accommodated. If alterations are possible, the original arrangements may be cancelled, and any applicable cancellation fees, as well as the additional cost of the new arrangements, will be the responsibility of the customer(s)/traveller(s).

ALTERATIONS TO THE TOUR/TRAVEL ARRANGEMENTS BY US
India Tours and Travels is committed to providing our valued customer(s)/travellers(s) with exceptional tour arrangements that meet their expectations. However, we acknowledge that unforeseen circumstances may arise, which could result in changes to the accommodation, internal trains and flights, international flights, or the sightseeing schedule. We assure you that we will make every effort to minimize any inconvenience caused by such changes and will communicate with you promptly and transparently to ensure that your tour experience remains enjoyable and memorable.

India Tours and Travels would like to assure its customer(s)/traveller(s) that in the event of significant changes to travel plans, they will be informed promptly, if possible. The company understands that such changes can be inconvenient and will do its best to provide suitable alternative arrangements. Please note that a significant change refers to a change of airport for international/domestic flights to and from the holiday destination, the rescheduling of the outward or return journey by more than twelve to sixteen hours, or the omission of a featured overnight stop in the itinerary.

In cases where changes are necessitated by circumstances beyond our control, which may constitute Force Majeure events, such as but not limited to the following: advice to avoid or depart from a specific country, unavoidable technical issues with transportation and/or cancellation of scheduled international and domestic flights/transportation services, war, civil unrest, terrorist activities, riots, labour disputes, route/lock closures, natural or nuclear disasters, fire, chemical or biological disasters, adverse weather conditions, epidemics and pandemics acts of government including national or local/port authorities and all similar events beyond our or our suppliers' control. India Tours and Travels reserves the right to adjust tour/travel arrangements as necessary depending on the circumstances without offering any compensation.

If such conditions arise before departure, India Tours and Travels will make every effort to provide suitable alternative arrangements. This may include offering comparable options, postponing the holiday, relocating to an alternative destination, or providing a full refund of the amount paid. The company values customer satisfaction and will work diligently to find a solution that meets their needs and preferences.

18.2 CANCELLATIONS

IF YOU CANCEL YOUR TOUR/TRAVEL ARRANGEMENTS

(i) SUBMITTING A CANCELLATION REQUEST
A cancellation request for booking made online must be submitted in writing through email at support@indiatoursandtravels.com from the lead participant’s registered email authorising India Tours and Travels to cancel all the elements of the tour/travel arrangements. All cancellations are considered non-reversible once received by India Tours and Travels. A cancellation fee will be charged by India Tours and Travels for all cancelled bookings for any reason as per the following terms.

IF INDIA TOURS AND TRAVELS CANCEL YOUR TOUR/TRAVEL ARRANGEMENTS

The Company reserves the right to cancel your booking in the following circumstances.

If the number of participants for a tour falls below the minimum required (4 for most tours or 6 for certain tours), applicable to tours categorized under Upcoming Group Journeys only.

For tours categorized under Upcoming Group Journeys only, if late cancellations from other clients occur after the minimum number of participants has been reached, the minimum number may no longer be met

Due to non-payment or delayed payment of the remaining balance, an alternative tour or refund will not be available, and cancellation charges may apply.

Under uncontrollable circumstances such as Force Majeure, which may include, but are not limited to, adverse weather conditions, epidemics and pandemics, cancellation of scheduled international or domestic flights/transport services, advice from the Government to avoid or leave a particular country, war, civil strike, terrorist activity, riots, industrial disputes, labour strikes, border/route/lock closures, unavoidable technical problems with transport, natural or nuclear disasters, fire, chemical or biological disasters, acts of government including national or local/port authorities, and all similar events outside of India Tours and Travels’ control.

CREDIT NOTES AND REFUND POLICY

19.1 When India Tours and Travels will not issue refunds and credit notes.

Please note that customer(s)/traveller(s) will not receive a refund or credit note if they need to cancel or modify their arrangements under any of the following circumstances.

a If customer(s)/traveller(s) chooses to cancel a tour/travel arrangement after booking through our website for any reason.

b If the customer(s)/traveller(s) choose to cancel a tour/travel arrangement after booking due to their failure to read and comply with our Terms and Conditions, Website General Terms of Use, Cancellation & Refund Policy, or any other important information listed on our website. It is the customer(s)/traveller(s) responsibility to familiarize themselves with these documents and ensure compliance before making a purchase.

c If the customer(s)/traveller(s) chooses to cancel their tour/travel arrangements in between, there will be no refund or credit notes for the unused portion of your arrangements.

d If the customer(s)/traveller(s) fail to settle the balance amount due for your upcoming on time as mentioned in the “Deposit” section.

e If customer(s)/traveller(s) miss or are a 'no-show' for a flight (international/domestic), train, luxury train, or cruise, resulting in the cancellation of their flight/train/luxury train/cruise ticket, accommodation, transfer, or any other travel component offered.

f If customer(s)/traveller(s)cannot travel due to other personal or travel-related commitments.

g. If the tour/travel arrangement experience did not meet customers' general expectations as described (for any reason)

h. If customer(s)/traveller(s) are refused or denied entry to a destination due to failure to meet health, visa entry, or any other requirements.

i If India Tours and Travels cancels customer(s)/traveller(s) tour/travel arrangements due to fraud, abuse, or suspicious activity.

j When India Tours and Travels makes changes to the customer(s)/traveller(s)’ tour/travel arrangements by providing a service of comparable or higher standard.

19.2 When India Tours and Travels may issue refunds and credit notes.

India Tours and Travels understands that customer(s)/traveller(s) may seek a refund if Travel Services are significantly changed or affected, or if their circumstances change. However, processing refunds can be challenging as the company has already paid the suppliers of the Travel Services on behalf of its customers. Nevertheless, India Tours and Travels may provide a refund or credit note under the following circumstances:

a Any applicable merchant fees imposed by Visa, Mastercard, Amex, and other payment providers will be deducted.

b Supplier refund charges (such as airline, train or cruise ship processing charges)

c Cancellation charges as mentioned.

d Any other non-refundable travel service/item

e Any request for a refund or credit may be denied or reduced if customers fail to adhere to India Tours and Travels' terms and conditions. The company's decision regarding any refund request is final, and no further correspondence will be entertained.

CREDIT CARD CHARGEBACKS/DISPUTES

As our valued customer(s)/traveller(s), we understand that you may occasionally encounter issues with charges on your credit card statement. In such cases, we would like to assist in resolving any questions or concerns you may have before you dispute the charges with your credit card company. At India Tours and Travels, we strive to provide exceptional customer service and are committed to working with you to resolve your concerns satisfactorily. We kindly request that you reach out to us before filing a "chargeback" with your credit card company, as we would appreciate the opportunity to assist you first. Please note that India Tours and Travels reserves the right to dispute any chargeback that we believe is improper.

India Tours and Travels would like to clarify that in the event of a chargeback related to any travel arrangement, we may need to cancel the said arrangement. We regret any inconvenience this may cause but please understand that we must take appropriate action to protect our business. We appreciate your understanding and cooperation in this matter.

We kindly ask that you take note of India Tours and Travels' cancellation policy when booking a tour or travel arrangement through their services. By doing so, you acknowledge and agree to the terms and conditions of India Tours and Travels.

India Tours and Travels respectfully request that our valued customer(s)/traveller(s) refrain from initiating improper chargeback claims (explained below). If such claims are made, we reserve the right to investigate and address them fairly and impartially, while also seeking to recover any associated costs.

• Chargebacks resulting from the purchase of a non-refundable Tour/Travel arrangement for which India Tours and Travels cannot provide a refund, whether or not the Tour/Travel arrangement is used.

• Chargebacks arising from the failure to deliver a Tour/Travel arrangement in a manner that’s consistent with the product/service description.

• Chargebacks arising from changes in the Tour/Travel arrangement, accommodation, transportation, tour leader, local guides, sightseeing and domestic flights, trains, meal plan, etc. after making the booking and during the tour by India Tours and Travels.

• Chargebacks arising from the loss/theft of personal belongings such as cash, any kind of jewellery, wallets, purses, luggage passports any document related to travel, insurance, medical and any other valuables.

• Chargebacks resulting from force majeure, including but not limited to, adverse weather conditions, epidemics and pandemics, cancellation of scheduled international or domestic flights/transport services, advice from the Government to avoid or leave a particular country, war, civil strike, terrorist activity, riots, industrial disputes, labour strikes, route/lock closures, unavoidable technical problems with transport, natural or nuclear disasters, fire, chemical or biological disasters, acts of government including national or local/port authorities, and all similar events outside of our or our suppliers' control.

COMPLAINTS

We struggle very hard to ensure your arrangements are delivered smoothly, however, there are times when problems arise while on tour. If any customer(s)/traveller(s) is not satisfied with any aspect of their arrangements, they must immediately bring it to the attention of India Tours and Travels Head office based in Gurgaon by calling, messaging on 24X7 number or emailing us at support@indiatoursnadtravels.com provided in your documents so that we may use reasonable endeavours to rectify the situation immediately.

Customer(s)/ traveller(s) are solely responsible for the safety and security of their personal belongings such as cash, any kind of jewellery, wallets, purses, luggage passports any document related to travel, insurance, medical and any other valuables. India Tours and Travels and its executive/representatives shall not be held responsible or liable for any loss/damage, in case of any pickpocketing or thefts.

If your issue remains unresolved despite communicating with our local agents during your holiday, please submit a written complaint to us within 30 days after your holiday ends. We will conduct a thorough investigation and respond as soon as possible. We take all complaints seriously and are committed to diligently addressing any concerns or issues you may have encountered.

BEHAVIOUR AND CONDUCT

Customer(s)/traveller(s) must maintain a certain code of conduct while travelling to India, Nepal, Bhutan, Sri Lanka and the Maldives. All customer(s)/traveller(s) must respect the local culture and religion during the tour. India Tours and Travels reserves the right to terminate the participants travelling with a group or private/tailor-made tours of the individual in the event of a breach of behaviour and conduct and hurting fellow customer(s)/traveller(s) or disrespecting the country’s citizens, culture or religion in which they are travelling.

Customer(s)/ traveller(s) are solely responsible for the safety and security of their personal belongings such as cash, any kind of jewellery, wallets, purses, luggage passports any document related to travel, insurance, medical and any other valuables. India Tours and Travels and its executive/representatives shall not be held responsible or liable for any loss/damage, in case of any pickpocketing or thefts.

JURISDICTION

Your relationship with India Tours and Travels or any disputes or other matters arising from it shall be interpreted as per Indian Law’s & Court in New Delhi (India).

ERRORS AND OMISSIONS

All the details including tours, itinerary, departure dates, prices, inclusions, exclusions, monument rides, local guides, transportation, terms of use, and booking conditions are prepared with the utmost attention. Still just in case of any error or omissions India Tours and Travels reserves the right to change the same and shall notify you as soon as possible.
